Yes, please be advised that the Court granted Final Approval to this settlement on August 10, 2009 and that the settlement became effective on October 9, 2009.

If You Have Ever Owned Or Leased A 1999-2006 Model Year BMW 3 Series Vehicle, You May Be Entitled To Class Action Settlement Benefits.

Under the terms of a proposed class action settlement, class members may present their 1999-2006 Model Year BMW 3 Series vehicles to an authorized BMW dealership for inspection and, if needed, repair of the vehicle’s sub-frame. Class members may also be entitled to reimbursement of sub-frame repair expenses that they previously incurred.

What is this about?

A federal lawsuit claims that 1999-2006 Model Year BMW 3 Series vehicles have defects that cause fractures to occur in the rear-axle supports in the vehicle’s sub-frame. BMW denies all charges of wrongdoing made against it in the lawsuit.

What benefits are provided under the settlement?

If your vehicle is covered by the settlement, you will be able to participate in a National Sub-Frame Inspection and Repair Program. If you have already incurred out-of-pocket-expenses for sub-frame repairs, you may be eligible to receive reimbursement from BMW by submitting a claim form.

Who and what vehicles are covered?

You may be able to receive benefits under the settlement if you are a United States resident who currently owns or leases a 1999-2006 Model Year BMW 3 Series vehicle, or formerly owned or leased a 1999-2006 Model Year BMW 3 Series vehicle and paid for repairs of the vehicle’s sub-frame.

What should I do?

Get the complete information below and decide on your legal right to:

  • Remain in the class and present your vehicle for repairs, file a claim, object to or comment on the settlement. If you stay in the class you will be bound by the Court’s rulings.
  • Exclude yourself and keep your right to sue BMW on your own. You must exclude yourself or object/comment in writing by July 15, 2009.


  • The Court has appointed Counsel to represent everyone. If the settlement is approved, BMW will pay them separately in an amount to be determined by the Court, which in no event will reduce the settlement benefits available to the Class. You can also hire your own attorney at your own cost.
